Terms of Service

These terms are an agreement between you and VotedMenu (“VotedMenu”, “we”) for using votedmenu.com, its QR menus, apps and API (the “Service”). By using the Service or creating an account you accept them. If you don’t agree, don’t use the Service.
1. Who Can Use VotedMenu
You must be at least 16 years old (or older if your country requires it) to create an account. If you use the Service for a business, you confirm you’re allowed to accept these terms for it.
2. Your Account
- Give accurate information, confirm your email and keep your password safe. One account per person.
- You’re responsible for what happens under your account. Tell us at hello@votedmenu.com if you think it’s been misused.
- You can delete your account at any time from Account Settings.
3. Your Reviews, Photos and Other Content
You keep ownership of what you post. You give VotedMenu a worldwide, non-exclusive, royalty-free, transferable licence (with the right to sublicense) to host, store, reproduce, display, adapt (for example resize photos or excerpt reviews), publish and distribute it in connection with the Service, including through our API, partner and AI assistant integrations and in promoting VotedMenu. This licence ends when you delete the content or your account, except for copies others have already shared or that we must keep by law.
By posting, you confirm that:
- it reflects your own honest experience and follows our Review Guidelines;
- you have the rights to it (for example, you took the photos) and it doesn’t infringe anyone’s rights or break any law;
- no business paid, rewarded or gave you anything in exchange for it (VotedMenu coins, which never depend on what you write, are the only reward allowed), and you have no conflict of interest.
Ratings and reviews are the opinions of their authors, not of VotedMenu. We don’t check them before they appear, but we may remove or restrict content that breaks these terms or the law.
4. What’s Not Allowed
- Fake, paid, incentivised or coordinated reviews, or reviewing a business you own, work for or compete with.
- Harassment, hate, threats, sexual content, or sharing someone’s personal information.
- Impersonating others, or claiming a restaurant you don’t run.
- Scraping, copying or bulk-downloading the Service other than through the API under its terms, or getting around rate limits, API keys or security.
- Uploading malware, interfering with the Service, or using it for anything illegal.
5. Restaurant Owners
- Claims are checked by hand. You confirm the information and documents you give are genuine and that you’re authorised to act for the restaurant. We can refuse or withdraw owner access.
- Owners can update their restaurant’s profile, menu, offers and posts and reply to reviews, but can’t edit, hide or remove reviews or ratings.
- You’re responsible for the accuracy of your menu, prices, allergen information, offers and posts, and for following consumer protection and advertising laws. Don’t offer anything in exchange for reviews.
- People you add to your team act on your behalf; you’re responsible for them.
6. Developer API
- Keep API keys secret. You’re responsible for all requests made with your keys and for the charges they create.
- Requests are billed per request as shown on /developers; limits and your optional monthly cap apply.
- Show where the data comes from (“Data from VotedMenu”, and “© OpenStreetMap contributors” for place data), don’t present reviews as your own, and don’t use the API to build a substitute database or service that competes with VotedMenu.
- We may change, rate-limit or suspend API access to protect the Service, and we’ll give notice of breaking changes where we reasonably can.
7. Payments and Coins
Paid plans are sold through Dodo Payments, which acts as merchant of record: it processes the payment, issues invoices and handles applicable sales tax or VAT, and its terms also apply to the purchase. Subscriptions renew automatically until cancelled; you can cancel at any time in the billing portal, and access continues until the end of the paid period. Refunds follow our Refund Policy. We’ll tell you in advance about price changes, and they apply from your next billing period.
Coins. You earn VotedMenu coins for ratings and reviews under the rules on the Coins page. Coins are a loyalty reward, not money: they have no cash value, can’t be bought, sold or transferred, and you can lose them if the review that earned them is deleted or removed, if you break these terms or the Review Guidelines, or when your account is deleted. We may change how coins are earned or spent, with notice for significant changes.
8. Place Data and Links
Place names, locations and details come from OpenStreetMap contributors (licensed under the Open Database License) and from our members. They may be incomplete or out of date. Links to other sites, such as Google Maps, are provided for convenience; we don’t control those sites.
9. Reporting and Moderation
Anyone can report content they believe breaks these terms or the law, with the “Report” link or by email to legal@votedmenu.com. We review reports and may remove content or suspend accounts. When we remove your content, we tell you why; if you disagree, reply through the contact page and a person will look at it again. We may close accounts that repeatedly break the rules.

10. Our Rights
The Service, the VotedMenu name, logo and design, and our aggregated ratings and rankings belong to VotedMenu and its licensors. These terms don’t give you any right to use them except as needed to use the Service.
11. No Guarantees
The Service is provided “as is”. We don’t guarantee that it will be available without interruption, or that ratings, menus, prices, opening hours or other information are accurate or complete. Always confirm allergens and dietary information directly with the restaurant. Nothing in these terms limits rights you have under consumer law that can’t be excluded.
12. Limitation of Liability
To the extent the law allows, VotedMenu is not liable for indirect, incidental, special or consequential losses, or for lost profits, data or goodwill, and our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 100. These limits don’t apply to liability that can’t be limited by law, such as for death or personal injury caused by negligence, or fraud.
13. Responsibility for Your Use
If you’re using the Service for a business or through the API, you agree to cover our reasonable costs from third-party claims caused by your content or by your breach of these terms, except where we caused the problem.
14. Ending the Agreement
You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering the Service, and we’ll tell you unless that would be unsafe or unlawful. Sections that by their nature should survive (such as licences already granted for shared content, disclaimers and liability limits) continue to apply.
15. Governing Law and Disputes
These terms are governed by the laws of Italy, and disputes go to its courts. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring claims in its courts. Please contact us first; most issues can be solved quickly.
16. Changes to These Terms
We may update these terms. For significant changes we’ll give you notice by email or on the site at least 30 days before they apply. If you keep using the Service after that, the new terms apply; if you don’t agree, you can delete your account.
